Overseas Property | Website Terms and Conditions

  1. Information: While Azure Overseas (herein referred to as Azure Overseas, US, WE, OUR and THE COMPANY), its associates, employees and agents to ensure that the information on the website, brochures and promotional material (including email newsletters) is correct, we make no guarantees to this effect, and nothing contained in any of the aforementioned documents/pages constitutes a contract or offer from AZURE OVERSEAS. It is the responsibility of the INTENDING PURCHASER (herein referred to as (INTENDING PURCHASER(S), POTENTIAL PURCHASER(S), PURCHASER, YOU, THEY and THEIR) to ensure that information issued in such documents as laid out above, or verbally stated by Azure Overseas and related third parties is correct to their satisfaction.
  2. Details: While AZURE OVERSEAS, its employees and related third parties make every effort to ensure that all information on our website and promotional material is kept up to date, we receive no guarantees from VENDORS that they will notify us of changes to the availability and price of products, and therefore WE can make no guarantees that a property or properties will still be available at the time of enquiry, nor that the price shown in OUR material will be correct. AZURE OVERSEAS reserves the right to make changes to any of the information on OUR website, including product prices, pictures, information and availability, at any time and without notice.
  3. Availability: AZURE OVERSEAS, its employees, and related third parties accept no liability for POTENTIAL PURCHASERS inability to view or purchase one or more of our products due to changes in availability, price or other unforeseeable circumstances.
  4. Services: All related services offered by AZURE OVERSEAS, including Financial, Insurance, and Currency Exchange, are provided by third parties unrelated to AZURE OVERSEAS, and only recommended by US in good faith. WE therefore accept no responsibility or liability for any contracts or agreements made with, kept or broken by these parties. Further, such contracts and agreements are the responsibility of said third parties and YOU.
  5. Currency exchange Rates: The asking price of overseas properties is usually denominated in its local currency and any Sterling prices usually only a guide. Changes in currency exchange rates, can greatly affect the asking price of overseas properties. WE ask that INTENDING PURCHASERS bear both these facts in mind and seek professional help when transferring money abroad to ensure they receive the most favourable rate.
  6. Business liability: AZURE OVERSEAS, its employees and related third parties act as introducing agents only. This means that we assist INTENDING PURCHASERS in finding and purchasing properties abroad. AZURE OVERSEAS accepts no responsibility or liability for any loss that may be incurred by said INTENDING PURCHASERS during the process of finding, attempting to purchase or purchasing property overseas.
  7. Measurements, tenure & usage: Sizes given on the AZURE OVERSEAS website and other AZURE OVERSEAS promotional material, in relation to land plots, rooms and properties is subject to a survey. It is again the responsibility of the INTENDING PURCHASER to ensure the correctness of any such information before purchasing, and WE accept no liability for the size(s) of properties purchased differing from those contained in OUR promotional material. Further, AZURE OVERSEAS does not check planning permissions, licenses, title or tenure, it is the responsibility of the INTENDING PURCHASER and/or anyone THEY employ to ensure that the property is within local laws and will be fit for THEIR intended purpose.
  8. Viewing & Travel: While AZURE OVERSEAS arranges viewings trips for INTENDING PURCHASERS to go and see properties THEY are interested in purchasing, WE are not responsible for any of the travel arrangements necessary to reach our properties, or accommodation during the visit. All arrangements, agreements and contracts the INTENDING PURCHASER makes or agrees to are the responsibility of THEM and the involved parties. AZURE OVERSEAS accepts no liability or responsibility for any problems experienced by either party during the fulfilment of these arrangements, agreements and/or contracts.
  9. How AZURE OVERSEAS gets paid for their service: AZURE OVERSEAS, its employees and agents are paid a share of the VENDORS profit from each sale. This is usually allocated as part of the VENDORS sales and marketing budget and not part of the price paid by the purchaser. Therefore, in most cases the advice and assistance we give, often invaluable, comes for free to the INTENDING PURCHASER. The exception to this is when a commission has not been made available by the vendor, and an admin fee is levied on the PURCHASER. This is very rare and always agreed with the PURCHASER well in advance of the purchase.
  10. Associated companies actions: AZURE OVERSEAS and its employees are not liable for the actions of any third party to which we may be connected or related in any way.
  11. Finance & Investment advice: Any finance and investment advice given by AZURE OVERSEAS its employees and related third parties is just that, Advice. WE make no guarantees as to the correctness of any such advice, and therefore accept no liability for any misgivings that arise from the direct and unquestioned following of said advice. INTENDING PURCHASERS are responsible to seek out professional advice on mortgages, financial planning and the potential risks of any investment.
  12. Disputes: Any disputes regarding property shall be resolved according to the laws of the country in which the property is situated and between the buyer and contracted seller.
  13. Insurances: When travelling abroad it is essential to arrange suitable comprehensive insurance cover. AZURE OVERSEAS, its employees and related third parties accept no liability for any loss, damage to personal property, or personal injury incurred or received during a viewing trip arranged by US. Insurance is also required on purchased properties. This is the sole responsibility of the PURCHASER.
  14. Building time on new property: While AZURE OVERSEAS, its employees and related third parties make every effort to ensure the accuracy of given timescales for the completion of properties being sold off the plan (aka off-plan properties); these estimates are given by the relevant construction company, who is also the party that the PURCHASER enters into a contract with, not US. WE therefore make no guarantees top the accuracy of said timescales, and accept no liability for any problems that may arise from inaccuracies therein.
  15. Access and use of the Azure Overseas Websites and content: All text content, images, logos, videos and other content on the AZURE OVERSEAS website is, unless otherwise stated, the intellectual property of AZURE OVERSEAS and partners. All rights are reserved, and any use of said content without prior permission is forbidden and will be pursued in accordance with any involved laws.
  16. Deposits: Unless agreed in advance deposits are non-refundable, with the exception of circumstances in which AZURE OVERSEAS, its employees or authorised associates deem a refund to be either fair or necessary. Note: these terms do not, nor do they attempt to countermand or infringe upon your statutory rights. None the less, WE must make clear that once the PURCHASER pays a deposit and exchanges contracts with a construction company, any refund is at the discretion of said construction company and their terms and conditions. Therefore AZURE OVERSEAS cannot be held liable for any refunds the PURCHASER is deems that he/she is entitled to, and further, it is the responsibility of the PURCHASER to read the terms and conditions of all contracts, and follow up any refunds or breaches with the parties co-signed on said agreements.
  17. Re-selling: While WE pride ourselves on bringing forward some of the world's best investment properties, WE cannot and do not pretend to be able to guarantee the future saleability of any property WE assist in the purchase of. As WE have no control over market conditions now or in the future, AZURE OVERSEAS, its employees, and related third parties cannot be held liable for an investment failing to live up to the PURCHASER's needs and/or expectations.
  18. Tax Liability: The PURCHASER is solely responsible and liable for any taxes that arise from the purchase, rental, or sale of any property purchased.
  19. Data Policy: When YOU register for a service with US, it is necessary for US to store details in order to provide said service(s) including YOUr name, address, email address and telephone number. WE may also need/see fit to share said details with carefully selected partner companies, as and when this becomes necessary to best provide said service. If YOU do not want your data to be shared with third parties YOU must notify US and WE will comply.
  20. Contact information: AZURE OVERSEAS, its employees and related third parties accept no liability for PURCHASERs who miss out on valuable information because they have failed to provide or keep up to date their contact information.
  21. Additional services: AZURE OVERSEAS, its employees and related third parties act as introducers only, WE are not responsible for the provision of bank accounts, NIE numbers, mortgages or any other such service/provision necessary to purchase foreign property.
  22. Agents and third party introducers: Where a PURCHASER is introduced through one of our partners, WE accept no liability or responsibility for for statements or terms made by such third parties, or the way in which they handle client funds.
